RESOLVED UNANIMOUSLY

a. That the application for the amendment of conditions of an existing approval, for Erf 78856 Cape Town at Diep River, as set out in Annexure A, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.

b. That the application for consent in terms of Item 55(b) of the Development Management Scheme to permit a restaurant on Erf 78856 Cape Town at Diep River, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015, subject to conditions contained in Annexure A.

Condition 2.1 is amended as follows:

2.1 The restaurant on the property shall not exceed the area indicated on the plan attached as Annexure C to the Departmental report to the Municipal Planning Tribunal with Case ID 70329456

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
