RESOLVED

a. That the application for consolidation of Erven 52291 & 58130 Cape Town, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with consolidation plan no LUM/00/52291, subject to the conditions contained in Annexure A.

b. That the application for rezoning of Erven 52291 & 58130 Cape Town from Single Residential Zone 1 to General Residential Subzone GR2, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. That the application consent for Erven 52291 & 58130 Cape Town to permit a place of instruction, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. That the application departures, as set out in Annexure A, for Erven 52291 & 58130 Cape Town, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.

The preamble contained in Annexure A that makes reference to the plans be amended as follows:

The departures are tied to the plans drawn by level 7 Architects, drawing numbers SD1, SD2 & SD3 all revision E, and all dated 21 February 2018

Departure (vi) is amended as follows:

(vi). Item 137: To permit 18 on-site parking bays in lieu of 29 parking bays required.

Conditions 2.1.2, 3.1.1, 3.1.3 and 3.3.1 are amended as follows:

2.1.2 The number of children on the property at any one time in relation to the combined place of instruction shall not exceed 160.

3.1.1 The envelope of buildings on the property shall not exceed that shown on the site development plan drawn by Level 7 Architects, with drawing numbers SD1, SD2 & SD3, all revision E and all dated 21 February 2018.

3.1.3 The use of the property is restricted to a block of flats not exceeding 6 flats and a place of instruction.

3.3.1 The owner/developer shall pay a development charge (DC) in accordance with the approved Development Charges Policy for Engineering Services for the City of Cape Town. The total amount payable for the proposed land use right in accordance with the attached DC calculation is R232 005.83. This amount was valid until 2018-06-30 and the amount due will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA. The DC is payable prior to approval of building plans relating to the flats or place of instruction or within 30 days of the approval of this application, whichever occurs first.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
