RESOLVED

a. That the application for deletion of restrictive title deed conditions, as set out in Annexure A, for Erf 32074 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. That the application for deletion of a condition of an existing approval, as set out in Annexure A, for Erf 32074 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. That the application for departures, as set out in Annexure A, for Erf 32074 Cape Town at Rosebank, BE APPROVED in terms of Section 98(b) except departure 1.3.1 contained in Annexure A which is REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015,

d. That the application for Council’s approval in terms of Item 162(1) of the Development Management Scheme to permit building work in a heritage protection overlay zone, as set out in Annexure A, for Erf 32074 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

Departure 1.3.1 is refused

REASONS FOR DECISION:

The MPT approved the reasons as set out in the planner’s report for the approvals.

Reason for REFUSAL of departure 1.3.1 contained in Annexure A

1. The negative impact of the balcony on the adjoining properties.
