UNANIMOUSLY RESOLVED that:
a. The application for the subdivision of Erf 411, Croydon, 14 Gay Street into two portions (Portion 1 being 248m² in extent and the remainder being 248m² in extent) BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law in accordance with plan no C5758/Sub, Dated July 2017;
b. The application for the relaxation of the 4m height restriction within the 3m common building line to 7.536m to allow for the proposed dwellings as indicated on drawing no. 2017-CS-19-001, Dated 2017-05-27 in respect of Erf 411, Croydon, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law;
c. The application for the relaxation of the permissible 1.5m distance applicable to windows to 1m to allow for the proposed dwelling windows as indicated on drawing no. 2017-CS-19-001, Dated 2017-05-27 in respect of Erf 411, Croydon, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 7.1.2 and 7.1.3 as follows:
7.1.2 The proposed subdivision can be viewed as compatible in the subject area, particularly the immediate context and will result in the optimal utilization of the property
7.1.3 The proposed dwellings will be of an appropriate scale and form and will thus relate to the surrounding urban fabric and development pattern of the surrounding neighborhood, particularly the immediate context and adheres to the architectural guidelines
