Resolution details

The application for departure for relaxation UNANIMOUSLY RESOLVED that:

a. The application for departure in terms of Section 126(a) of the Municipal Planning By-Law to allow for the ground floor of a building (balcony 6) to be raised more than 1,5m from existing ground level on Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

b. of the 3m common building line (Adj to Erf 973) to 2.2m for the purpose of extending the existing balcony (balcony 6) in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

c. The application for departure for relaxation of the 3m common building line (Adj to Erf 3343) to 0m for the purpose of erecting a raised deck walkway/ staircase in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

d. The application for departure for relaxation of the 3m common building line (Adj to Erf 3343) to 2,5m for the purpose of extending the chimney in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

e. The application for departure for relaxation of the 3m common building line (Adj to Erf 973) to 0m for the purpose of erecting a screen wall higher than 2,1m on the ground floor in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

f. The application for departure for relaxation of the 3m common building line (Adj to Erf 973) to 0m for the purpose of erecting a screen wall higher than 2,1m on the first floor in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

g. The application for departure for relaxation of the 5m street building line (Beach Road) to 0m for the purpose of erecting a garage in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.


h. The application for departure for relaxation of the 3,5m street building line (Beach Road) to 1,3m for the purpose of erecting an entertainment pavilion in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

i. The application for departure for relaxation of the 5m street building line (Faure Street) to 0,73m for the purpose of erecting a deck in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

j. The application for departure for relaxation of the 4m overlay height to 5,2m in respect of Erf 3344, Gordon’s Bay, BE APPROVED in terms of Section 98(b)(i) of the Cape Town Municipal Planning By-Law, 2015, in accordance with plan 2016.18 300.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
