UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 7 457,00 BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised use on Erf 6110, Somerset West.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to replace reason 6.2 with the following:
Lack of cooperation by failing to provide Council with the correct information about the use of the building is an aggravating factor.
