UNANIMOUSLY RESOLVED that:
a. The application for a consent use in terms of item 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a place of instruction (ECD Centre) from the portion of Erf 32188, 46 Jukskei Crescent, Beacon Valley Mitchell’s Plain, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in Annexure A.
b. The application for permanent departures in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit: One (1) on-site parking bay in lieu of two (2), Street building lines of 0m in lieu of 5m from Jukskei Crescent and the north and west common boundary, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015 in accordance with the drawing attached as Annexure C.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend conditions:
2.4 Building plans shall be submitted generally in accordance with drawing no: 32188, dated January 2017 (see Annexure C), with the exception that the existing carport located along the south boundary of the subject property shall remain a carport and shall not be converted to a classroom.
2.8 New condition:
Access to erven 32186 and 32187 Mitchell’s Plain, via the panhandle must not be impeded.
