RESOLVED UNANIMOUSLY

a. That the application for the removal of restrictive conditions of title, contained in Deed T56760/2016 [Clause D 1 (a), (b), (c) and (d)], of Erf 1296, 34 Ryger Street, Gordon’s Bay, to permit a use other than residential, more than one dwelling, the development of more than one fifth of the property and buildings nearer than 31,49m from north-western common boundary of the property, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with Plan No. VLL1, 1543/1rev.a, (sheet 1-3), dated 15/6/2017 and November 2016, respectively, subject to the conditions contained in Annexure A hereto;

b. That the application for a consent to utilize approximately 480m2 of the existing dwelling and outbuilding on Erf 1296, 34 Ryger Street, Gordon’s Bay, as a 5-bedroom guest house, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with Plan No. VLL1, 1543/1rev.a, (sheet 1-3), dated 15/6/2017 and November 2016, respectively, subject to the conditions contained in Annexure A hereto;

c. That the application for a permanent departure to allow for the use of existing dwelling and outbuilding on Erf 1296, 34 Ryger Street, Gordon’s Bay, for the purposes of a guest house, within 4,5m of the common boundaries of the property, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with Plan No. VLL1, 1543/1rev.a, (sheet 1-3), dated 15/6/2017 and November 2016, respectively, subject to the conditions contained in Annexure A hereto;

d. That the application for a permanent departure to relax the 3m common boundary building line along the north-eastern boundary, to between 0 and 1m, in order to regularize an existing scullery and store room, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with Plan No. VLL1, 1543/1rev.a, (sheet 1-3), dated 15/6/2017 and November 2016, respectively, subject to the conditions contained in Annexure A hereto;

e. That the application for a permanent departure, to provide a second vehicle entrance/exit, within 6 metres from the entrance/exit to abutting Erf1297, on Erf 1296, 34 Ryger Street, Gordon’s Bay, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with Plan No. VLL1, 1543/1rev.a, (sheet 1-3), dated 15/6/2017 and November 2016, respectively, subject to the conditions contained in Annexure A hereto.

REASONS FOR DECISION:

1. The proposal is consistent with Council policies and/or spatial plans;
2. The proposal will have a positive socio-economic impact in that job opportunities will be created and tourism boosted.
3. The proposal is compatible with surrounding land uses;
4. External engineering services have sufficient capacity to accommodate the proposed development;
5. The proposal will not have an adverse impact on the health and well-being of the surrounding community;
6. Imposed conditions will mitigate certain impacts of the proposed development, on the surrounding area.
