RESOLVED UNANIMOUSLY
a. That an administrative penalty in the amount of R 350.00 for unauthorized land use in terms of Section 129 and 42(r) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of in respect of Erf 4612 Blue Downs located at 45 Plane Street, Hindle Park BE APPROVED.
b. That an administrative penalty in the amount of R 220.00 for the unauthorized building work in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of in respect of Erf 4612 Blue Downs located at 45 Plane Street, Hindle Park BE APPROVED.

REASONS FOR DECISION:

The MPT approved the application for the reasons as set out in the planner’s report and amended reason 6.4 as follows:

6.4. The applicant has taken the necessary steps to regularize the unauthorized activity subsequent to the section 126 notice being served, which was served on 12 March 2017.
