RESOLVED UNANIMOUSLY
a. That the application for a consent use in terms of item 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a house shop from the portion of erf 5674, Mitchell’s Plain, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in the attached Annexure A.
b. That the application for a permanent departure in terms of section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit a street building line setback of 0m in lieu of 3.5m for the house shop, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in accordance with plan contained in Annexure C.
Condition 2.4 to be amended as follows:
2.4 That the house shop hereby permitted shall only operate or deliveries to be received between the hours of 07:00 to 21:00, Mondays to Saturdays and 08:00 to 13:00 on Sunday and public holidays.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
