RESOLVED UNANIMOUSLY
a. That the application for a consent use in terms of item 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a house shop from the portion of erf 10137, Mitchell’s Plain, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in the attached Annexure A.
b. That the application for a permanent departure in terms of section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the proposed house shop on erf 10137, Mitchells Plain to be setback of 0m in lieu of 1.0m from street building line, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015 in accordance with the plan contained in Annexure C.
c. That the application for a permanent departure in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 on erf 10137, Mitchells Plain to permit (1) one on-site parking bay in lieu of (2) two on-site parking bays, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015 in accordance with the plan contained in Annexure C
Condition 2.4 to be amended as follows:
2.4 That the house shop hereby permitted shall only operate or deliveries to be received between the hours of 07:00 to 21:00, Mondays to Saturdays and 08:00 to 13:00 on Sunday and public holidays.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
