UNANIMOUSLY RESOLVED that:

a. The application for rezoning of Erf 29-RE, Schaapkraal from Rural to Local Business 2 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for departures for Erf 29-RE, Schaapkraal to permit two carriageway crossings of 5,6m in lieu of 4,0m BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. The Site Development Plan, Plan no. 1 for Erf 29-RE, Schaapkraal BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 4 as follows:

The rezoning will not significantly impact on the health, safety and well-being of the surrounding community. The proposal has been carefully designed to minimize over-looking and noise generation.

Amend conditions as follows:

1.1 Rezoning from Rural to Local Business 2 to permit a Place of Instruction, an ancillary place of worship and boarding for learners, only.

2.1.1 The development shall be implemented generally in accordance with the approved Site Development Plan, Plan no. 1 and the Elevations prepared by M. Amien Kagee dated January 2016, as per Annexure C.

2.2.1 A detailed landscape plan and amended Site Development Plan, prepared by a registered landscape Architect / technician, shall be submitted to the satisfaction of the Director: Development Management for approval prior to the submission of building plans.


2.4.3 The owner shall pay a financial contribution towards the provision of bulk civil engineering services in the amount of R 968 980.56 in accordance with the set relevant policy. Such payment shall be made prior to final building plan approval.
NOTE: An amended SDP may result in an amended DC being payable.
