UNANIMOUSLY RESOLVED that:
a. The application for City approval to permit demolition and building work within a Heritage Protection Overlay Zone BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the drawings in Annexure C and subject to the conditions in Annexure A.
b. The application for a height departure to permit the building to be 75m in lieu of 60m BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the drawings in Annexure C and subject to the conditions in Annexure A.
c. The application for street building line departures in respect of portions of the building below 60m above base level BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the drawings in Annexure C and subject to the conditions in Annexure A.
d. The application for street building line departures in respect of portions of the building above 60m above base level BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the drawings in Annexure C and subject to the conditions in Annexure A.
e. The application for Council approval to permit parking closer than 10m from street boundaries at first storey level BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the drawings in Annexure C and subject to the conditions in Annexure A.
f. Council agreement to permit the building to be 0m in lieu of 5m from a Metropolitan Route BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the drawings in Annexure C and subject to the conditions in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
The proposal satisfies the desirability criteria contained in Section 99(3) of the MPBL.
