RESOLVED that:
a. The application to amend restrictive title deed conditions, as set out in Annexure A for Erven 28549 and 28550 Cape Town at Mowbray, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application to consolidate Erven 28549 and 28550 Cape Town at Mowbray, as per plan of consolidation LUM/00/28549, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for rezoning of Erven 28549 and 28550 Cape Town at Mowbray from Single Residential Zone 1 to General Residential Subzone GR2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The application for Council's approval in terms of Item 162(l) of the Development Management Scheme, as set out in Annexure A for Erven 28549 and 28550 Cape Town at Mowbray, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
e. The application for departures, as set out in Annexure A, for Erven 28549 and 28550 Cape Town at Mowbray, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend conditions:
References to ‘a full-time manager’ must include the words ‘who is not a student’, will reside on the property.
A noise management plan shall be submitted by the applicant to the satisfaction of the Director: Development Management for approval, addressing inter alia, noise and procedures to manage the behavior of students which shall be implemented by the owner of the property
