RESOLVED that:
a. The application for rezoning of Erf 28450 Cape Town at Mowbray from Single Residential Zone 1 to General Residential Subzone GR2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for Council’s approval in terms of Item 162(1) of the Development Management Scheme, as set out in Annexure A, for Erf 28450 Cape Town at Mowbray, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for departures, as set out in Annexure A, for Erf 28450 Cape Town at Mowbray, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
It is desirable to have student accommodation close to tertiary institutions.
Add conditions as follows:
A noise management plan shall be submitted by the applicant to the satisfaction of the Director: Development Management for approval, addressing inter alia, noise and procedures to manage the behavior of lodgers which shall be implemented by the owner of the property.
There shall be a manager, who is not a student, living on the premises
Amend conditions as follows:
All references to ‘domestic staff quarters’ must be replaced with ‘staff quarters’
1.3 Departures:
ii. Item 41(e): To permit the building to be sited 3.25m in lieu of 4.5m from Glencaird Road.
v. Item 137: To permit 2 on-site parking bays in lieu of 3 bays.
