RESOLVED UNANIMOUSLY

That an administrative penalty for the unauthorized land use (ECD centre) in the amount of R340 in terms of Section 129 of the City of Cape Town Municipal Planning B-Law,2015 BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law,2015 in respect of Erf 868, 868 Buhlungu Street Village 2B Brown Farm Philippi.

REASONS FOR DECISION:

1. Period is significant although it was the current operator’s grandmother that started the ECD Centre.
2. No record could be found of previous contraventions of the By-Law or of the planning law.
3. The applicant has taken the necessary steps to regularize the unauthorized place of instruction(ECD) from operating from the portion of the subject property.
4. The activity is considered low key in nature, does not deviate from the residential character of the area and supports local economic development.
5. The activity is considered small scale in nature and does not detract from the appearance of the property as a residence.
