UNANIMOUSLY RESOLVED that:

a) The application for consent in terms of Item 21(c) of the Development Management Scheme to permit Erf 546 Bergvliet to be used as a place of instruction BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions contained in Annexure A.

b) The application for departures for Erf 546 Bergvliet, as contained in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the plan attached as Annexure C.

c) The application for the deletion and amendment of restrictive conditions for Erf 546 Bergvliet, as set out in Annexure A, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.

d) The application for the deletion and amendment of conditions of an existing approval imposed in terms of the Townships Ordinance No 33 of 1934 relating to Erf 546 Bergvliet, as set out in Annexure A, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.


ADDITION TO CONDITIONS:

2.6: Development Contribution
2.6.1 The owner/developer shall pay a development charge (DC) in accordance with the approved Development Charges Policy for Engineering Services for the City of Cape Town. The total amount payable for the proposed land use right in accordance with the attached DC calculation is R 54 100.93. It must be noted that this amount was valid until 30.06.2017 and will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA. Such payment shall be made prior to the operation of the ECD Centre or the approval of any building plan relating to the ECD Centre, whichever occurs first.

NOTE: Failure to pay the full DC liability will be construed as non-compliance to the conditions of approval.
