RESOLVED that:
a) The application for amendment of condition 3.2 for Erf 11397 Constantia, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b) The application for the deletion of condition 2.1 and amendment of condition 3.3 BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT partially APPROVED the application for the reasons set out in the Planner’s Report.
The MPT partially REFUSED the application for the following reason:
It would be more appropriate to consider the amendment and deletion of conditions 2.1 and 3.3 at the time of any other application to change the non-conforming use.
AMENDMENT TO CONDITIONS:
1.1 inclusive and 1.2(ii) omitted as a result of the part refusal.
1.2 renumbered to 1.1 and to read as follows: ‘Condition to be amended in terms of Section 100 of the By-Law’…
