RESOLVED that:

The application for consent in terms of Item 21(c) of the Development Management Scheme to permit a halfway house on Erf 1137 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

AMENDMENTS TO CONDITIONS:
2.2 to read as follows: ‘No more than 6 residents of the halfway house shall be accommodated on the property at the same time (this excludes staff that may reside on the property)’.
2.3 to read as follows: ‘Management must be present at the premises on a full-time basis to manage, inter alia, potential nuisance aspects’

2.4 to read as follows: ‘That the consent use hereby approved is limited to a 5-year period from the date of final notification of the decision’

Numbering sequence to be updated accordingly:
2.5 ‘The property shall retain its residential appearance…’
2.6 ‘A single, un-illuminated sign or notice…’ etc
NOTE: It is recommended that the premises should make application to the Department of Social Development to be registered as a halfway house.
