UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R0 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 895, Philippi at Schaapkraal in accordance with Drawing No:01/16; Drawn by: R.A; Dated: 03 June 2016; Pg Nos: 01 and 03 for the unauthorized poultry house.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:
The scale of the property is that of a single residential dwelling being part of a general plan and it would be inappropriate to apply the agricultural development parameters to determine such penalty and rather to apply the single residential development parameters to the property.
