UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 93.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 120, Highlands Estate at Philippi in accordance with Drawing Reference Number: 2017.01.0187, Drawn by: Ebrahim; Dated: January 2017 for the unauthorized garage, laundry room and pool.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and added the following reason:
The scale of the property is that of a single residential dwelling forming part of a general plan and it would be inappropriate to apply the agricultural development parameters to determine such penalty and rather to apply the single residential development parameters to the property.
