RESOLVED UNANIMOUSLY

That an administrative penalty in terms of Section 129 of the City of Cape Town Municipal Planning By-Law; 2015 equal to R1000.00 , BE APPROVED for the unauthorised land use (ECD).

REASONS FOR DECISION:

1. The applicant indicated that the ECD has been in operation on the subject property for four years, without any approval from Council. The applicant previously applied for land use rights, but withdrew the application. The applicant was therefore aware of the unauthorized use and did not cease the operation of the ECD.
2. The provision of ECD facilities is very important in terms of the social benefits to the surrounding communities.
