RESOLVED UNANIMOUSLY
That the 0% administrative penalty in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 6352, Goodwood BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015.
REASONS FOR DECISION:
1. The conduct of the applicant in applying for the rectification / regularization of the unauthorized building work without any delay is seen in a positive light as wanting to ensure compliance with Council’s regulations.
2. The deceased owner was responsible for the construction of the structures without the required approval of Council, and it would be inappropriate to penalize any beneficiaries of the Estate who were not responsible for such unauthorized building work.
