a. That the application for a consent use to permit a freestanding base station on Erf 22528, Parow BE APPROVED in terms of section 98(b)(i) of the Municipal Planning By-Law, 2015, subject to conditions attached as Annexure A.
b. That the application for a permanent departure to relax the 5m lateral building line to 0.0m on Erf 22528, Parow BE APPROVED in terms of Section 98(b)(i) of the Municipal Planning By-Law, 2015, subject to conditions attached as Annexure A
c. That the application for the amendment of title deed condition clauses II C.1(a) imposed in Title Deed no. T38822/1996 on Erf 22528. Parow, BE APPROVED in terms of Section 98(b)(i) of the Municipal Planning By-Law, 2015, subject to conditions attached as Annexure A, to read as follow,:
“Die eiendom sal slegs vir kerkdoeleindes gebruik word, met die uitsondering van die oprigting van 'n sellulêre kommunikasie basisstasie en gepaardgaande infrastruktuur en die Koper sal ‘n kerkgebou en/of sodanig ander gebou of geboue wat die verkoper skriftelik goedkeur op die eiendom oprig.”
CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW
LAND USE
Condition 2.3 to be amended as follows:
2.3 The applicant will be responsible for the implementation of landscaping within the confines of the telecommunication compound as well as that indicated on the Amended Site Development Plan, within 1 month from the date of the installation of the telecommunication infrastructure.
Conditions 2.14, 2.15 and 2.16 to be added:
2.14 That the maximum height be 21m.
2.15 That the mast be disguised as a tree.
2.16 That the antennae on the mast should not be lower than 15m.
REASONS FOR DECISION:
The MPT approved the application for the reasons as set out in the planner’s report and amended reason 7.1.2 to read as follows:
7.1.2. The application is compatible with surrounding uses as telecommunication base stations are currently forming part of the built environment landscape.
