RESOLVED UNANIMOUSLY

a. That the application for consent use in order to permit a place of worship on erf 1847, 5 Sayed Abdul Samad Road, Westridge Heights, Schaapkraal, BE APPROVED in terms of Section 98(b)(iii) of the of the City of Cape Town, Municipal Planning By-Law subject to the conditions as set out in the attached Annexure A.

DEPARTURES GRANTED IN TERMS OF SECTION 98 OF THE BY-LAW

Condition 2.2 is deleted.

CONDITIONS IMPOSED IN TERMS OF SECTION 100 OF THE CAPE TOWN MUNICIPAL PLANNING BY-LAW, 2015

Conditions 3.1, 3.2 and 3.5 are amended as follows:

3.1 Building plans, parking and landscaping submitted shall be in accordance with drawing no 15012016-01, Revision A, dated March 2016 (see Annexure C)

3.2 Erven 1846 and 1847 shall be notarially tied, in order for these erven to function as one, which shall be finalized prior to building plan approval.

3.5 if applicable the applicant will be responsible for the payment of a development contribution, with reference to the consent use on erf 1847, to be calculated and paid to the satisfaction of TDA prior to building plan approval.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
