RESOLVED UNANIMOUSLY

That it BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 to impose an administrative penalty in the amount of R23108.00 representing 20% of the sum of (i) the municipal value of the area that is used unlawfully and (ii) the value of the unlawful building work across the building line, on Erf 6295, Macassar.

REASONS FOR DECISIONS:

1. The applicant, notwithstanding being familiar with the procedures required erected the cell mast and base station unlawfully which does not show good conduct.
2. The owner admitted that he had contravened and submitted the relevant application for the determination of an administrative penalty without delay.
3. The duration of the contraventions is for a short period.
4. As far as can be determined, it is the owner’s first offence of this kind.
