RESOLVED UNANIMOUSLY
That an administrative penalty in the amount of 2% or R4 370 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1613, Somerset West
REASONS FOR DECISION:
1. Commencing with the operation of the ECD Centre without first ensuring that the required land use approval has been obtained, cannot be condoned. Mere submission of the application is not sufficient.
2. An administrative penalty of 2% is seen to be appropriate given the nature and intensity of use associated with an ECD Centre and its resultant potential negative impacts on the surrounding residential area.
