RESOLVED UNANIMOUSLY

a. That the application in terms of Section 42(g) of the Cape Town Municipal Planning By-Law, 2015 for Council’s consent to allow for the relaxation of a condition in title deed T50594/1990 Clause E 5(c) to allow for the construction of a leant-to roof at 0m in lieu of 3.15m and 1.57m respectively from the rear and lateral boundary on Erf 240, 33 Albatros Crescent, Strand BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015.

b. That the application in terms of Section 42(b) of the Cape Town Municipal Planning By-Law, 2015 for permanent departure from the 3m common building line required for 40% of the length of common boundary (excluding the first 12m) to allow for regularization of the existing garage and proposed lean-to at 0m for a length 14.58m on Erf 240, 33 Albatros Crescent, Strand BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 subject to the conditions contained in Annexure A to the report.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
