UNANIMOUSLY RESOLVED:
a. That the application for the Rezoning of Erf 380, Brackenfell, from single Residential 1 to General Business 1 to permit a business premises BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015 subject to the conditions contained in Annexure A.
b. That the application for the Removal of Restrictive Title Condition B.6(b)(c)&(d) of Title deed T28780/15 relating to Erf 380, Brackenfell BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. That the application for the deletion of conditions in respect of an existing approval relating to Erf 380, Brackenfell BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
Annexure A
1. APPLICATIONS GRANTED IN TERMS OF SECTION 98 OF THE BY-LAW
Application 1.1 to be amended as follows:
1.1. Application for rezoning in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015 from Single Residential 1 to General Business 1.
2. CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW
DEVELOPMENT MANAGEMENT
Condition 2.1 to be amended as follows:
2.1. That the business premises shall be limited to a beauty salon with a maximum of 5 treatment rooms within the dwelling on the land unit.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
