UNANIMOUSLY RESOLVED that:
a) An administrative penalty in the amount of R 1 122.00 BE APPROVED for the unauthorised liquor shop on erf 28994, Dunoon in terms of Section 129 of the City of Cape Town Municipal Planning By-Law (2015), and such penalty be approved in terms of Section 98(b) of the said By-Law.
b) An administrative penalty in the amount of R 407.00 BE APPROVED for the building line encroachment on erf 28994, Dunoon, in terms of Section 129 of the City of Cape Town Municipal Planning By-Law (2015), and such penalty be approved in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s
Report and agreed to amend reason 3 as follows:
The unlawful operation of a liquor shop in a residential neighbourhood is
considered relatively serious.
