After discussion, the panel agreed to reduce the penalty amount.

UNANIMOUSLY RESOLVED that:

a) An administrative penalty in the total amount of R 16 885.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 417, Milnerton, for the unlawful office use, and approved in terms of Section 98(b) of the said By-Law (2015).

b) An administrative penalty in the amount of R 641.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 417, Milnerton, for the unlawful building work, and approved in terms of Section 98(b) of the said By-Law (2015).

REASONS FOR DECISION

1. The applicant has shown good faith in their prompt application to rectify the contraventions.
2. The unlawful land use is of a large scale and unlawful building work is of a minor scale and is not deemed to pose a threat to the safety, health and wellbeing of the surrounding community.
3. The unlawful use has not ceased.
