UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 320.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 5229, Wesfleur in accordance with plan no’s A-D.F./16/04-13 and A-D.F./16/07-23, attached as Annexure B for the unlawful structure, and approved in terms of Section 98(b) of the said By-Law (2015).
REASON FOR DECISION
The building line encroachment has minimal impact on its surroundings and the building has been constructed due to logical reasons not attributable to willful engagement in illegal building work.
