RESOLVED UNANIMOUSLY:
a. That the application for temporary land use departure in order to operate a luxury hydro day Spa from erf 8719, Somerset West, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-law, 2015 subject to the conditions contained in Annexure A.
b. That the application for the amendment of the approved Site Development Plan No. 02/2013 which bears Council’s stamp dated 21/01/2013 and Landscape Plan no SDP/001 which bears Council’s stamp dated 14/11/2014 for the proposed Spa in combination with the existing boutique guest lodge, in accordance with the amended Site Development Plan No. 0461-kliphuis-pt1028-20141028 dated 10/08/2016, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-law, 2015.
c. That the application for permanent departure to permit the proposed reception area and store room 1.5m in lieu of 6.0m from the northern common boundary, BE APPROVED in terms of Section 98(B) of the Municipal Planning By-law, 2015.
2. CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW RELATING TO THE DEPARTURE APPROVAL
DEPARTMENT: DEVELOPMENT MANAGEMENT (DM)
Condition 2.3 to be amended and reads as follows:
2.3 That no restaurant, bar or conference facility which is open to the general public shall be permitted on the property.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
