Resolution details

UNANIMOUSLY RESOLVED that:

a) The application for deletion and amendment of restrictive conditions, as set out in Annexure A, for Erven 1089, 1099 and 1120 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b) The application for deletion and amendment of conditions of an existing approval, as set out in Annexure A for Erven 1089, 1099 and 1120 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c) The consolidation of Erven 1089, 1099 and 1120 Constantia, as shown on plan of consolidation LUM/16/1089, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d) The application for consent in terms of Item 21(c) of the Development Management Scheme to permit an institution on the consolidation of Erven 1089, 1099 and 1120 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

e) The application for a departure, as set out in Annexure A, on the consolidation of Erven 1089, 1099 and 1120 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.


REASONS FOR DECISION

1. The proposal complies with the Municipal Spatial Development Framework, Southern District Plan, Densification Policy, Urban Design Policy, Gated Development Policy, Boundary Walls and Fences Policy and the Scenic Drive Management Plan and Policy.
2. The massing of the buildings and level of densification is contextually appropriate.
3. The proposal will not negatively affect the character of the area or impact negatively on the neighbouring properties in any significant way.
4. The amended design has carefully taken into account the character of the area, impact on surrounding properties and retention of trees.
5. The impact on the natural environment will be low.
6. The proposal will have no negative heritage impact.
7. The proposal will not cause any negative traffic related impact, and is supported by TCT and Province
8. Adequate municipal services are available.
9. The deletion of the title deed conditions complies with the requirements as set out in the Municipal Planning By-Law 2015, the Land Use Planning Act, 2014 and the Spatial Planning and Land Use Management Act, 2013.
10. This facility will be managed and operated as an Institution.

AMENDMENTS TO CONDITIONS:

All development on the property shall be generally in accordance with the plan, drawing number 0466/SK 1001-A, as indicated on Annexure F
Amend 8.9.1 as follows: ‘This consent applies only to an institution for the accommodation of aged or retired persons, and associated facilities including frail care’
Amend 8.9.2 as follows: ‘The institution shall comprise of no more than 88 dwelling units and a frail care facility of no more than 20 beds’.
Amend 8.9.3: delete ‘retirement village’ – replace with ‘institution’
