UNANIMOUSLY RESOLVED that:
a. An administrative penalty in the amount of R 20 000.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erven 28549 & 28550 Cape Town at Mowbray with regard to the previous unauthorised use of the property as a boarding house.
b. An administrative penalty in the amount of R0 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erven 28549 & 28550 Cape Town at Mowbray with regard to the unauthorised building work on the property amounting to ±201m2.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s
Report
Reason 4 was amended to read as follows:
The person involved has previously contravened a previous planning By-Law on three other properties in the Mowbray area.
