UNANIMOUSLY RESOLVED

a) An administrative penalty to the amount of R4799.88 (20%) BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised use on Erf 28654, Bellville in accordance with the Site Plan attached as Annexure B.

b) An administrative penalty to the amount of R33950.00 (20%) BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised structure on Erf 28654, Bellville in accordance with the Site Plan attached as Annexure B.




REASONS FOR DECISION:

1. The conduct of the applicant is unacceptable; it is a wilful disregard of the Municipal Planning By-law.
2. The cell mast and base station was erected without authority which shows that the applicant was driven by commercial consideration.
3. The applicant did not apply for an administrative penalty it was brought to Councils attention by the ward councillor and subcouncil office.
