RESOLVED UNANIMOUSLY
That an administrative penalty for the unauthorised land use (liquor shop) in the amount of R29 516.00(25%) in terms of Section 129 and 42(q) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 5514 located at 23 Magalies Road, Eersteriver BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law 2015.
REASONS FOR DECISION:
1. The duration of the unauthorized use has been fairly long (in excess of 4 years).
2. The owner has contravened planning law in the past.
3. The applicant has not stopped the illegal activity since becoming aware of its unauthorized nature.
