RESOLVED UNANIMOUSLY

That an administrative penalty for the unauthorized land use in the amount of R14 406 (25%), in terms of Section 129 and 42 (q) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 32841, 148 Hunt Crescent, Beacon Valley, Mitchells Plain BE APPROVED in terms of section 98(b)1 of the City of Cape Town Municipal Planning By-Law, 2015.



REASONS FOR DECISION:

1. The applicant has previously contravened the By-Law and continued to operate the tavern, despite the application being refused.
2. The applicant has taken the necessary steps to regularize the unauthorized activity.
3. The owner of the property has been operating the tavern from 2014, thus the duration is long standing.
