RESOLVED UNANIMOUSLY

That a 5% administrative penalty in the amount of R4505.00 BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015 for the unlawful building work in respect of Erf 13526, Wilhelmina Schaeffer Street, Strand in accordance with Plan No1405Rev02 dated November 2016.

REASONS FOR DECISION:

1. The owner is responsible for unlawfully constructing the dwelling extensions and take full responsibility for the contravention.
2. The duration of the contravention is approximately 8 years with an extent of 15.75m²
3. The owner of the property has never contravened this by-law or any other planning statute.
4. The extension of the unauthorized building work onto the street boundary line is viewed in a serious light.
