RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R31 696.00 (0.5%) (rounded off) BE APPROVED in terms of section 89 of the City of Cape Town Municipal Planning By-Law, 2015 for unlawful additions to the existing building 3 and gazebo in respect of Erf 653, Somerset West in accordance with drawing number SD100.00 dated 6/04/2017.


REASONS FOR DECISION:

1. The unauthorized building work contravenes the Development Management Scheme and deviates from the approved SDP. However, the overall impact is minimal.
2. The extent of the contravention is not insignificant.
3. The owner had admitted that he had contravened and submitted the application to regularize the situation and for the administrative penalty on his own initiative, but just took a long time.
4. It is the owner’s first offence of this kind.
5. The applicant did not provide adequate motivation.
