UNANIMOUSLY RESOLVED that:

The application for removal and amendment of title deed restrictions and regulation departures as listed in Annexure A in respect of Erf 119, Clifton BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. The proposal complies with the criteria set out in Section 99 of the Municipal Planning By-Law 2015 (as amended).
2. The proposal complies with the Cape Town Spatial Development Framework and Table Bay District Plan.
3. The built form is appropriate in the context.
4. The proposal will conform to the residential nature and character of the area.

5. The common and street boundary building line bears no adverse impact on the built form as it relates to an existing structure.
6. The removal and amendment of the restrictive conditions which enables the related concentration of the built form is compliant with legislation.
7. Despite the removal of the restrictive title deed conditions, the underlying Single Residential Zoning 1 controls development of any further additions or alterations. Overlay zones provide further controls

Amendments to title deed conditions:
Remove conditions (D)(a)2 and (D)(a)3
Amend 1.2 condition (D)(a)4 as follows: ‘That not more than one building be erected on any one lot’.
