UNANIMOUSLY RESOLVED that:

The application for a departure, as set out in Annexure A, for Erf 1872 Bergvliet, BE APPROVED in terms of 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION

1. The proposal will not affect the character of the area or have a significant impact on the property to the north.
2. The proposal is not inconsistent with the Southern District Plan and the Cape Town Spatial Development Framework.
3. The proposal will have no negative socio- economic impact.
4. The windows along the common boundary are small and the staircase will be enclosed with frosted glass on the side, thereby not creating a privacy issue.
5. The departure relates to a small length of the common boundary and is on the southern side of the objectors’ property, thereby not affecting views, light or sun.
6. The building height of the addition is ±6.9m above base level which is considerably lower than 11m that can be built on the property as of right. A building of this height, even if it is compliant with the 3m setback, would have a far greater impact on the objector’s property compared to what is currently proposed.
7. The proposal does not lack desirability or impact on existing rights.
