UNANIMOUSLY RESOLVED that:

a. The application for Amendment of General Plan No: 10077 through the Closure of Portions of Public Street (Mohan Avenue) in terms of Section 42(l) of the City of Cape Town Municipal Planning By-Law, 2015 relating to erven: 111227, 111226, 111225, 111224, 111223, 111222, 111213, 111214, 111215, 111216, 111217, 111218 & 111219, Cape Town at Gatesville, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for Consolidation in terms of Section 42(f) of the Municipal Planning By-Law, 2015, of Erven: 111227, 111226, 111225, 111224, 111223, 111222, 111213, 111214, 111215, 111216, 111217, 111218 & 111219, Gatesville, Cape Town, Cape Town at Gatesville, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.




c. The application for Rezoning of the abovementioned consolidated erf (created by 8.3 above), in terms of Section 42(a) of the Municipal Planning By-Law, 2015, from Single Residential 1 and Transport Zone 2 to Subdivisional Area Overlay Zone to allow Single Residential 2 Zone and Transport Zone 2 (public road) in accordance with subdivision plan no AR/SUB/ 1600711.100 rev 00 dated 11/07/2016, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

d. The application for Subdivision of the abovementioned consolidated erf, in terms of Section 42 (d) of the City of Cape Town Municipal Planning By-Law, 2015 in accordance with the abovementioned Subdivisional Area Overlay Zone BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with subdivision plan no AR/SUB/ 1600711.100 rev 00 dated 11/07/2016, subject to the conditions contained in Annexure A.

REASONS FOR DECISION:

1. The proposal is in line with and satisfies the principles of the IDP, MSDF, CFDP, and Densification Policy specifically in terms of well-located infill residential development.
2. The proposed development will have a positive impact on the character and development of the area through the formalization of the existing Pooke se Bos informal settlement.
3. The proposed residential use is compatible with surrounding industrial, community and residential land uses.
4. The proposal will result in the formalisation of the informal settlement and go a long way in aiding in the alleviation of many social problems experienced by the residents of the settlement as well as surrounding residents.
5. The close proximity of transport, commercial and other community facilities makes this a prime location for residential use, specifically for the lower income groups.
6. The proposal is in line with the City’s directives for integrated human settlements.
7. The approval of the proposed development application will further contribute to social and economic upliftment in an area which has been identified as a priority area in this particular regard.
8. The proposed development will have a positive impact on the economic well-being of the community by providing social and affordable housing opportunities.
9. Adequate bulk and link engineering services exist for the proposed development.
10. No significant impact on the existing traffic and parking situation in the area is envisaged.
