RESOLVED UNANIMOUSLY:
a. That the application for a temporary departure to permit light steel fabrication and assemblies within an extension to an existing double garage and an outbuilding on Erf 5728, 4 John Walls Street, Strand, BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto;
b. That the application for a permanent departure to encroach the 3m common boundary building line on the aforesaid property, by 0.5m for extensions to an existing outbuilding/garage, BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto;
CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW
2.1 RELATING TO THE PERMANENT DEPARTURE APPROVAL:
2.1.2 LAND USE MANAGEMENT
Condition 2.1.2.10 to be amended as follows:
2.1.2.10 That the temporary departure be granted in respect of the entire business activity, which shall be valid for a period of 2 years from date of final notification and that no further temporary departures will be granted.
2.1.3 ROADS & STROMWATER AND WATER & SANITATION
Condition 2.1.3.2 be deleted.
REASONS FOR DECISION:
1. The proposal will have a short term positive socio-economic impact in that it will provide job opportunities (whilst under construction) and an improved living environment for the applicant/owner;
2. The proposal entails work of which the scale is limited and which is confined to buildings, which will lessen the impact on neighbouring residential properties;
3. Engineering services surrounding the subject site (including the road network) will not be impacted on by the proposal as it will not lead to more people residing on the property.
4. The proposal will have no impact on any heritage aspects due to the fact that the existing structure is relatively new and the absence of any building or features of historical or cultural significance in the surrounding area;
5. Vehicular site access will remain unaltered, which, together with the limited nature of the proposal will not impede on the flow of traffic in the adjoining street;
6. The building line encroachment is minimal and will not lead to overlooking, overshadowing or obstruction of primary views;
7. The building line encroachment is at the rear of the property and will have no adverse impact on the streetscape.
