RESOLVED UNANIMOUSLY
a. That the application for the removal of the restrictive title deed conditions, clauses B(a) of the Title Deed No T98656/2006 in respect of Erf 755, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law,
b. That the application for consent use for the operation of an ECD centre (36 children) on Erf 755, Gordon’s Bay BE APPROVED in terms of section 98(b)(i) of the Planning By-Law in accordance with Plan No. 2015-053, subject to conditions as per Annexure A.
c. That the application for the departure to permit a relaxation of the 5m common boundary building line (Adjacent to Erf 753) to 4m as indicated on plan 2015–053 in respect of Erf 755, Gordon’s Bay, BE APPROVED in terms of Section 98(b) (i) of the Cape Town Municipal Planning By-Law.
REASONS FOR DECISION:
The MPT approved the application for all reasons set out in the planners report except for reason 7.1.4 which was amended to read as follows
4. The removal of the restrictive Title Deed is appropriate in this area.
