RESOLVED UNANIMOUSLY

a. That the application for a consent use in terms of section 42(i) of the City of Cape Town, Municipal Planning By-Law, 2015 in order to operate a place of worship from a portion of erf 1387 Kleinvlei, BE APPROVED in terms of Section 98 (b)(iii) of the Municipal Planning By-law, 2015 subject to the conditions contained in Annexure A .

b. That the application for a permanent departure in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to provide 0 parking bays in lieu of 8 parking bays on erf 1387 Kleinvlei, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 subject to the conditions contained in Annexure A.

CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW

TRANSPORT & URBAN DEVELOPMENT AUTHORITY (TDA)

That a new condition is added as 2.2 and that the 2.2 in planners report change to 2.3

2.2 That the number of congregants be limited to 48 per service and that all place of worship activity be held inside the part of the building designated for purpose of worship.

Condition 2.5 in planner’s report (which will change to 2.6) to be amended as follows:

2.6 That during church services the music and sound may not be amplified through any electronic means.

The MPT APPROVED the application for the reasons set out in the Planners’ report.
