RESOLVED UNANIMOUSLY
That a 0% administrative penalty be imposed in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 for the unlawful building work in respect of Erf 8659, 60 Voortrekker Road Street, Somerset West in accordance with Plan No 15.5015.1 dated 27.10.2015
REASONS FOR DECISION:
1. The unlawful structure was constructed in 2004 nine years before the property was sold to the current owner, hence he is not responsible.
2. The owner has never contravened the By-law and acted in good faith by regularising transgressions of previous property owner.
