Resolution details

UNANIMOUSLY RESOLVED:

a) That the application for the removal of restrictive Title Deed conditions, Clause B. (c) & (d) of the Title Deed No T 42418/2004, in respect of Erf 10059, Goodwood to allow for only the implementation of the development rules of the Development Management Scheme on the subject property BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

b) That the application for permanent departure in respect of Erf 10059, Goodwood to permit the relaxation of the 5 m street building line and 3 m common boundary building line to 0 m to permit a dwelling extension, covered braai area, store room, swimming pool, swimming pool dressing room, store, double garage, verandas and carport BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT APPROVED the application for the removal of the Title Deed restriction and REFUSED the application for permanent departures for the reasons set out in the Planners’ report.
