UNANIMOUSLY RESOLVED:

That the application for an administrative penalty of 5% of the value for the unauthorized land use (i.e. R8606.25), namely a playschool being operated from Erf 481, Bellville, BE APPROVED in accordance with Plan No 481/16/02 dated 05/09/2016, attached as Annexure B, in terms of Section 98(b) with reference to Section 129(7) of the City of Cape Town Municipal Planning By-Law, 2015

REASONS FOR DECISION:

1. Council should not disadvantage an applicant who is attempting to regularize their small business by imposing a high penalty.
2. A small administrative penalty is considered appropriate, considering the number of months that the business has been in operation.
