Resolution details

UNANIMOUSLY RESOLVED:

a) That the application for section 42 (a) – rezoning in respect of Erven 13555-RE and 13548, Goodwood, from General Business (GB1) and Erven 13556 & 13547, Goodwood, from Transport Zone (TR2) to General Residential (GR2) Zone, to permit the construction of two four storey building comprising of a total of 40 residential flat units BE APPROVED in terms of Section 98 (B) the City of Cape Town Municipal Planning By-law, subject to the conditions contained in Annexure A.

b) That the application for section 42(f) – consolidation of Erven 13555-RE, 13556, 13547, 13548, Goodwood, as indicated on the Consolidation Diagram attached as Annexure E, BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.

c) That the application for section 42(b) - permanent departures in respect of Erven 13555-RE, 13556, 13547 and 13548, Goodwood, for the relaxation of the street building line (Van Reenen and Marais Streets) from 4,5m to 2,0m, the relaxation of the 4,5m common boundary building line to 3,0m, increase in permissible bulk from 1 to 1,05 and departure from the required 80 on-site parking bays to 40 bays, BE APPROVED, in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-law, accordance with the Site Development Plan , No GW/Ms/1 dated February 2016, attached as annexure C, subject to the conditions contained in Annexure A.

CONDITIONS IMPOSED IN TERMS OF SECTION 100 OF THE CITY OF CAPE TOWN MUNICIPAL PLANNING BY-LAW

LAND USE MANAGEMENT

This condition to be amended as follows:

1. That an amended Site Development Plan (SDP) be submitted for approval by the Commissioner TDA.
2. That the development be restricted to total of 40 residential flats units.
3. That a landscaping plan shall be prepared to the satisfaction of the Commissioner TDA.

FIRE AND RESCUE SERVICES

Condition 19 to be deleted.

WATER AND SANITATION

Conditions 23, 24, 25 to be deleted.

REASONS FOR DECISION:

1. The proposed parking, access and egress arrangements comply with the requirements of the Department TCT: Integrated Transport Planning
2. Because of the proximity to Voortrekker Road the provision of 40 parking bays in lieu of 80 is considered to be adequate.
3. The proposal is in line with the forward planning initiatives, for the area close to Voortrekker Road.
4. the positioning and internal layout of the buildings will not result in a significant negative impact toward abutting properties in terms of sunlight and privacy
